Terms of Use

These general conditions govern access to and use of the Elitechip App application, owned by Elitechip, S.L., a company with registered office at Calle Velázquez, 8A, 07760 Ciutadella de Menorca, Spain, with tax ID (CIF) B57506149.

Anyone accessing the web application must read the General Conditions in force at the time of access, and must refrain from using it if they do not fully agree with their content. The mere use of the web page confers the status of "user" and implies full acceptance of these General Conditions. For this reason, we ask you to read this document carefully.

Through its Elitechip general content and services app, Elitechip offers the Customer the following complementary features and facilities:

• Access to a range of content organised by category.
• Online registration for competitions managed by Elitechip.
• A system connecting like-minded people and groups to exchange information.
• Tools that allow you to express yourself and communicate about the topics that matter most to you.
• Access to the most notable news of the last few hours.
• Competition results lookup services.
• Foreground and background geolocation services.
• Any other service that Elitechip may integrate into its app in the future.

Elitechip may, in the future, provide users with new content, services or additional facilities, whether free of charge or not, that enhance the offering.

In turn, Elitechip reserves the right to unilaterally cancel any of the content, services or utilities incorporated.

All services are provided to you personally and you will access them via the Internet using the device and operating system of your choice: desktop or laptop computer, mobile phone, tablet, console and other devices available on the market from which the web page can be accessed.

Use of the App is free of charge, on the understanding that the costs of Internet access, as well as those arising, where applicable, from acquiring licences for software applications needed to use the web page, are borne by the user.

The user accepts that use is in all cases at their sole and exclusive responsibility. In using it, the user undertakes not to misrepresent their identity, not to engage in any conduct that could damage the image, interests or rights of Elitechip SL or of third parties, or that is contrary to the law, morality or public order, or that could damage, disable, overload or in any way impair the normal use of the web page.

Elitechip SL adopts security measures to detect the existence of viruses. However, the user is aware of and accepts that the security measures available for computer systems on the Internet are not entirely reliable and that, therefore, Elitechip SL cannot guarantee the absence of viruses or other elements that could cause alterations in the user's computer systems (software and hardware) or in their electronic documents and the files they contain.

All content included in the App — including but not limited to distinctive signs, logos, photographs, excerpts of audiovisual works, graphic designs or any other content — is subject to intellectual and industrial property rights of which Elitechip SL or its business partners are the exclusive owners or assignees to the required extent, and is protected by copyright under Spanish legislation and other laws.

It is the user's responsibility to ensure that the content they publish complies with Spanish legislation on intellectual and industrial property rights.

The reproduction, distribution or public communication of the web page, of any of its parts or of the software is contrary to the Spanish Intellectual Property Law and may entail civil and criminal penalties. It is also not permitted to remove notices or material available on the web page relating to copyright or similar rights.

The downloading and digital reproduction of other content of the App, or parts of it, are only permitted for personal, non-commercial use.

The information and services in the app are provided without any express or implied warranty as to their accuracy or completeness. Elitechip SL also has the right to modify, suspend or withdraw the content or services of any of the products described in the app at any time and without prior notice.

If you consider that the app contains any unlawful or rights-infringing content, content subject to copyright that has not been authorised for online communication, false attributions of authorship, criminal offences, offences against people's honour and privacy, or infringements of protected trademarks, among others, you can report it to: info@elitechip.net

The message must include the reference "Infringing or unlawful content" and contain the following information:

• Your name, surname, national ID number and contact details
• The content or contents of the web page that you consider rights-infringing or unlawful
• The reason why you consider that content to be unlawful, as well as the rights infringed and who is responsible
• A statement in which you take responsibility for the truthfulness of this communication

Elitechip SL is not responsible for communications between the app and you. Furthermore, if links are established to a third-party web page, Elitechip SL is likewise not responsible for the content of such third-party pages. This includes links to partners' web pages that may use Elitechip SL logos as part of a co-branding agreement.

Elitechip SL cannot, under any circumstances, be held liable for damages of any kind arising from use of the app, including, but not limited to, loss of income, business interruptions, loss of data, malfunctions or similar losses.

All materials, information or other communications provided and/or published by you in the app will be considered non-confidential and non-exclusive, and do not entitle you to any kind of reimbursement or other royalties. Elitechip SL may use such materials, information, etc., free of charge, including for the granting of licences for their exploitation, albeit with respect for your privacy.

It is prohibited to use the web page to publish or transmit any material that is or may be illegal, threatening, misleading, subversive, defamatory, invasive of privacy, obscene, abusive, discriminatory or unlawful, or any material that could constitute or encourage conduct that would be considered a criminal offence, violate the rights of any party, or give rise to civil liability or violate any law.

It is also prohibited to use the web page to advertise or carry out any commercial activity.

Elitechip reserves the right to require users to register in order to access certain services or information in its Content App, for which they will be asked to choose a password enabling the personal identification of the user ("username" and "password"). Once their profile has been created, the user identifier will be unique across all Elitechip platforms and the companies related to it. The access credentials assigned are personal and non-transferable, and their transfer to third parties, even temporarily, is not permitted. In this respect, the user undertakes to make diligent use of, and keep secret, the password(s) and username(s) assigned, where applicable, to access the App and/or the Content. In the event that the user knows of or suspects the loss, theft or use of their password by third parties, they must bring this to the attention of Elitechip SL as soon as possible. The user will be responsible for the expenses and for the damages caused by the access to and use of the App and/or the Content by any third party using the user's password(s) and username(s) as a result of non-diligent use or loss of these by the user.

The user may only access the services and materials of the App and/or the Content by the means or procedures made available for this purpose in the App itself and/or in the Content, or those commonly used on the Internet for this purpose, provided that they do not involve a violation of Intellectual/Industrial Property rights, or any kind of damage to the App and/or the Content, or to its information or the services offered.

The user undertakes to use the services, information and materials of the App and/or the Content in accordance with the law and with these General Conditions. Under no circumstances may the user's use of the App and/or the Content infringe current legislation, morality, good customs or public order, and the user must at all times make correct and lawful use of the services, information and materials of the App and/or the Content.

The user may:

• Access and browse the materials and services of the App and/or the Content free of charge and without prior authorisation, without prejudice to the requirement of prior registration and/or acceptance of Particular Conditions for certain specific services and content, as determined in these General Conditions or, where applicable, in the Particular Conditions of those services.
• Use the services and materials of the App and/or the Content exclusively for private use.

Under no circumstances may the user carry out the following activities:

1. Disseminate content or propaganda of a racist, xenophobic, pornographic, obscene or denigrating nature, or content that incites or promotes the commission of criminal, violent, defamatory or degrading acts on grounds of age, sex, religion or beliefs; or that directly or indirectly makes, promotes or incites the glorification of terrorism, or that is contrary to human rights and the fundamental rights and freedoms of third parties, to current legislation, morality, good customs and public order, or with harmful aims that could prejudice, damage or in any way prevent access to them, to the detriment of Elitechip SL or of third parties.
2. Carry out acts contrary to the Intellectual and/or Industrial Property rights of their legitimate owners.
3. Cause damage to the computer systems of Elitechip SL, its suppliers or third parties and/or introduce or spread computer viruses, harmful code or software or any other type of system that could cause damage or alterations to computer systems, or unauthorised alterations to the content, programs or systems accessible through the materials or services of the App and/or the Content, or to the information systems, files and computer equipment of their users, or gain unauthorised access to any materials and services of the App and/or the Content.
4. Transmit advertising by any means and, in particular, by sending electronic messages, where the sending of the advertising has not been requested or authorised by the recipient.
5. Use the App and/or the Content, in whole or in part, to promote, sell, contract or disclose advertising or information, whether their own or that of third parties, without the prior written authorisation of Elitechip SL.
6. Use the services and materials offered through the App and/or the Content in a manner contrary to the General Conditions and/or the Particular Conditions governing the use of a given service and/or content, or to the detriment or impairment of the rights of other users.
7. Remove or modify in any way the protection or identification devices of ELITECHIP SL or its legitimate owners that the App and/or the Content may contain, or the symbols, logos or trademarks that ELITECHIP SL or the legitimate third-party owners of the rights incorporate into their creations and that may be subject to intellectual or industrial property.

The User will be liable to ELITECHIP SL, or to third parties, for any damages of any kind that may be caused as a consequence of the breach or non-observance, direct or indirect, of these General Conditions. ELITECHIP SL will at all times ensure respect for the current legal system, and reserves the right to deny, at its discretion, totally or partially, at any time and without prior notice, any user's access to the Website and/or the Content, where one or more of the circumstances described in this clause apply.

Elitechip SL is not responsible for the opinions expressed in the comments, images, videos and, in short, material — whether multimedia, visual, audio or text — submitted by users, and such material will be deactivated when deemed appropriate.

Access, registration, browsing, use, hosting and/or downloading of materials and/or use of the services by anyone under 16 years of age is prohibited. By registering, the user responsibly declares and guarantees that they are at least 16 years old.

Elitechip SL cannot verify the accuracy of the data provided, nor will it be responsible for anyone under 16 years of age who accesses its App and/or the Content in breach of this access condition.

We reserve the right to revise these terms and conditions of use at any time.

Elitechip SL reserves the right, at its own discretion and without prior notice, to remove information from the web page or to suspend it.

If any part of these terms and conditions is found to be illegal or invalid and therefore unenforceable, this will not affect the validity and enforceability of the remainder of the terms and conditions.

These general conditions are governed by ordinary Spanish law.
